Terms of Service
These Terms of Service (“Terms”) govern your use of the Psalm 77 mobile application (the “App”) and the psalm77.xyz website (together, the “Service”) operated by BluNote (“we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms.
1. The Service
Psalm 77 is a personal testimony journal that lets you record, revisit, and optionally share moments of God’s faithfulness. The Service is provided for your personal, non-commercial use.
2. Account & Eligibility
You must be at least 13 years old to create an account. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us at support@psalm77.xyz if you suspect unauthorized access.
3. Your Content
You retain full ownership of every testimony, photo, tag, and other content you create in the App (“Your Content”). By using the Service, you grant us a limited, non-exclusive, royalty-free license to host, store, transmit, and display Your Content solely so that we can deliver the Service to you.
When you choose to share a testimony — by tapping “Share Testimony” or “Export as Image” — you authorize us to make that specific testimony accessible at a public preview URL or as a downloadable image. Sharing is opt-in per testimony; you can stop sharing at any time by deleting the testimony.
4. Acceptable Use
You agree not to:
- Use the Service in violation of any law or regulation.
- Upload content that infringes a third party’s rights, contains hateful or harassing material, or depicts illegal activity.
- Attempt to access another user’s account or data.
- Reverse-engineer, scrape, or interfere with the Service’s normal operation.
- Use the Service to send unsolicited or commercial messages.
We may suspend or terminate accounts that violate these rules. Egregious violations may also be reported to the appropriate authorities.
5. Intellectual Property
The App, the website, the Psalm 77 name, the design system, and the software powering the Service are the intellectual property of BluNote. The Scripture text quoted within the App is from the King James Version, which is in the public domain in most jurisdictions.
6. Subscriptions & Pricing
Psalm 77 is offered free of charge at present. If we introduce paid features in the future, those features will be governed by separate in-App purchase terms presented through the Apple App Store. We will not retroactively gate features that you used for free.
7. Termination
You can delete your account at any time via the in-App flow (Profile → Settings → Delete Account). Upon deletion, your data is permanently removed as described in our Privacy Policy. We may suspend or terminate your account, with or without notice, if you breach these Terms or if the Service is discontinued.
8. Disclaimer of Warranties
The Service is provided “as is” and “as available.” We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components. Use of the Service is at your own risk.
9. Limitation of Liability
To the maximum extent permitted by law, BluNote shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to your use of the Service, including but not limited to loss of data, loss of revenue, or business interruption. Our aggregate liability shall not exceed the greater of AUD $100 or the amount you paid us in the past twelve months.
10. Indemnification
You agree to indemnify and hold BluNote harmless from any claim or demand arising out of your breach of these Terms, your violation of any law, or your infringement of any third-party right.
11. Governing Law
These Terms are governed by the laws of New South Wales, Australia, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms shall be brought in the courts located in Sydney, NSW, unless required otherwise by mandatory consumer-protection law in your jurisdiction.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced in the App and reflected in the Effective date above. Continued use of the Service after a change constitutes acceptance of the revised Terms.
